Terms of Service

These Terms of Service ("Terms") govern access to and use of the Photo Repair Lab website located at photorepairlab.com and the related photo restoration, enhancement, editing, inpainting, upscaling, colourisation, and other AI-powered image services made available through it (together, the "Services"). These Terms form a binding agreement between Photo Repair Lab ABN 22 681 999 744 of PO Box 78, Milsons Point, NSW, 1565, Australia ("Photo Repair Lab", "we", "us", or "our") and the person or entity using the Services ("you", "your"). By creating an account, clicking to accept these Terms, purchasing Services, or otherwise accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your place of residence, to use the Services. You must have authority to enter into these Terms. If you use the Services for an organisation, you represent that you are authorised to bind that organisation. The Services are not directed to children.

2. The Services

Photo Repair Lab provides a hosted software service that allows users to upload digital images and request AI-assisted restoration, repair, enhancement, and related processing. Features may change from time to time, and some features may be added, modified, suspended, or removed. Because the Services rely on artificial intelligence, automated systems, cloud infrastructure, and third-party providers, outputs may vary in quality and may not always be accurate, complete, authentic, historically correct, or suitable for your intended purpose. The Services are provided for general creative, consumer, and business use only and are not intended for forensic, evidentiary, identity verification, medical, insurance, legal, law-enforcement, or other high-risk use cases.

3. Account Registration and Security

You may need to create an account to access some or all of the Services. You must provide accurate, current, and complete account information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. Notify us promptly at support@photorepairlab.com if you suspect unauthorised access. We may suspend or restrict access where we reasonably suspect fraud, security issues, abuse, or breach of these Terms.

4. Fees, Orders and Payment

Some parts of the Services are paid. Pricing, billing mechanics, and included allowances are shown on the website or at checkout. You authorise us and our payment processor to charge the fees, taxes, and other amounts disclosed at the time of purchase. Unless expressly stated otherwise, all prices are shown in USD and are exclusive of any taxes that must legally be added. We may change pricing prospectively by updating the website or giving notice through the Services. Payment processing is performed by third-party providers including Stripe and is subject to their terms and privacy practices. If a payment is reversed, declined, or charged back, we may suspend access, reverse credits, withhold outputs not yet delivered, or recover reasonable costs to the extent permitted by law.

4A. Credit Validity and Expiry

Credits purchased, granted, or otherwise added to your account are valid for 12 months from the date they are added to your account. After this period, any unused credits will expire and be removed from your balance, and no refund will be payable for expired credits. We will normally send reminder emails before credits expire, but you are responsible for using your credits within the validity period and for keeping a current email address on your account. Credits granted as a signup bonus, promotional incentive, refund, or admin adjustment carry the same 12-month validity from the date they are added unless we expressly state a different period at the time of grant.

4B. Credit Consumption Rates

Credits are a unit of account used to access processing on the Services. They are not a fixed entitlement to a specific operation, output count, or service tier. The number of credits required to perform any operation (for example, "10 credits per standard restoration" or "20 credits per 5-second animated clip") reflects current AI model costs, infrastructure costs, and product configuration, and may change from time to time. We will normally provide reasonable notice through the Services or by email of any material increase to per-operation credit costs. Photo Repair Lab reserves the right to adjust per-operation credit costs prospectively. Any change applies to operations performed after the change takes effect, including operations performed using credits purchased earlier; it does not retroactively affect operations already completed and paid for. The current per-operation credit costs are displayed in the dashboard before each operation is started, so you can confirm the cost prior to use.

5. User Content

"User Content" means any image, photograph, prompt, instruction, metadata, text, or other material that you upload, submit, or generate through the Services, including any restored or enhanced output image. As between you and Photo Repair Lab, and subject to third-party rights and applicable law, you retain ownership of your original uploaded images. Subject to your compliance with these Terms and payment of applicable fees, Photo Repair Lab assigns to you any rights we may have in output images generated specifically for your account, to the extent such rights can legally be assigned. Because AI systems can generate similar results for different users and can incorporate errors or artefacts, we do not guarantee that any output is unique, non-infringing, fit for a particular purpose, or available for exclusive intellectual property protection.

You grant Photo Repair Lab a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, process, display, and otherwise use your User Content only to the extent reasonably necessary to operate, secure, maintain, troubleshoot, and improve the Services, provide customer support, enforce these Terms, comply with law, and perform your requested restoration or enhancement.

No model training: Photo Repair Lab does not use your uploaded images or output images to train its own foundation models, except where you separately and expressly agree.

You are solely responsible for your User Content and for ensuring that you have all rights, permissions, and consents needed to upload, process, edit, restore, store, and use it.

6. User Promises

You represent, warrant, and undertake that:

  • you own the User Content you submit, or have all necessary permissions, licences, and consents to use it and authorise Photo Repair Lab to process it;
  • your User Content and use of the Services will not infringe any copyright, moral right, trade mark, privacy right, publicity right, confidentiality obligation, or other third-party right;
  • you will not upload content that is unlawful, deceptive, exploitative, harassing, defamatory, obscene, or otherwise prohibited by these Terms or the Acceptable Use Policy;
  • where an image contains another identifiable person, you have any consent or authority required for the intended use;
  • you will not rely on the Services to create false evidence, impersonate persons, alter identity documents, create non-consensual intimate imagery, or mislead others about whether an image is authentic; and
  • you will comply with all applicable laws in connection with your use of the Services.

7. Storage, Delivery, and Deletion

Uploaded and generated images may be stored for up to 30 days from creation or processing, unless deleted earlier by you or removed earlier by us for legal, security, or operational reasons. During that period, you may be able to access, download, and delete completed images through your account dashboard. After the retention period, we aim to delete or de-identify stored image files from active systems automatically, subject to limited backup, security, legal hold, and technical recovery processes. We do not guarantee indefinite storage, and you are responsible for downloading and keeping your own copies of any output you want to retain. Account deletion does not necessarily remove information we are required or permitted to keep for billing, fraud prevention, legal compliance, dispute handling, or security purposes.

8. Acceptable Use

You must comply with the Photo Repair Lab Acceptable Use Policy, which forms part of these Terms. We may investigate suspected breaches and may remove content, disable access, suspend processing, report conduct to service providers or authorities, and terminate accounts where reasonably necessary.

9. Third-Party Services

The Services rely on third-party providers for AI processing, payments, communications, content delivery, hosting, storage, security, and email. Service performance may be affected by outages, latency, restrictions, policy changes, or failures of those providers. We are not responsible for separate products or services supplied by third parties, although we remain responsible to you for our own obligations under law and these Terms.

10. Intellectual Property in the Services

Photo Repair Lab and its licensors own all rights, title, and interest in the Services, software, workflows, website design, branding, documentation, and underlying technology, excluding your User Content and any rights expressly granted to you under these Terms. You must not copy, reverse engineer, scrape, frame, resell, sublicense, benchmark for a competing service, or otherwise misuse the Services except as permitted by law. No right is granted to use Photo Repair Lab's name, logos, or branding without prior written consent.

11. Feedback

If you provide suggestions, ideas, or feedback about the Services, you grant Photo Repair Lab a non-exclusive, perpetual, irrevocable, worldwide, royalty-free right to use that feedback for any lawful purpose without compensation.

12. Suspension and Termination

You may stop using the Services at any time and may request account deletion. We may suspend, restrict, or terminate your access immediately if we reasonably believe that: you breached these Terms or the Acceptable Use Policy; your use creates legal risk, security risk, or harm; we are required to do so by law or by an upstream provider; payment is overdue, reversed, or fraudulent; or continued provision is no longer commercially or technically feasible. On termination, clauses that by nature should survive do survive, including those dealing with payment, intellectual property, disclaimers, liability, indemnity, disputes, and retained data.

13. Consumer Rights and Refunds

Nothing in these Terms excludes, restricts, or modifies any non-excludable rights or remedies you may have under the Australian Consumer Law or other applicable consumer protection laws. Where the law allows, Photo Repair Lab's liability for failure to comply with a consumer guarantee in relation to services is limited to re-supplying the services or paying the cost of having the services supplied again. Refunds are also governed by the Photo Repair Lab Refund Policy.

14. Disclaimers

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or that all outputs will meet your expectations. AI-generated or AI-assisted outputs may contain inaccuracies, distortions, fabricated elements, missing details, artefacts, or features that are visually plausible but historically incorrect. You are responsible for reviewing all outputs before using, sharing, printing, publishing, or relying on them. We do not provide legal, archival, forensic, evidentiary, insurance, identity verification, or professional advice through the Services.

15. Indemnity

To the maximum extent permitted by law, you indemnify Photo Repair Lab and its officers, employees, and contractors against claims, losses, damages, liabilities, costs, and expenses arising from or related to your User Content; your breach of these Terms or the Acceptable Use Policy; your infringement of third-party rights; or your unlawful, fraudulent, or misleading use of the Services. This clause does not apply to the extent a claim is caused by Photo Repair Lab's own negligence, wilful misconduct, or breach of law.

16. Limitation of Liability

To the maximum extent permitted by law, Photo Repair Lab is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, business opportunity, goodwill, anticipated savings, or data. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence where applicable, or non-excludable consumer rights. Subject to the foregoing and to the maximum extent permitted by law, Photo Repair Lab's aggregate liability arising out of or in connection with the Services or these Terms is limited to the greater of: (a) the total amount you paid to Photo Repair Lab in the 12 months before the event giving rise to the claim; and (b) USD $100.

17. Changes to the Services or Terms

We may update the Services and these Terms from time to time. If a change materially and adversely affects your rights, we will take reasonable steps to notify you, for example by email or through the website. Your continued use after an updated version takes effect constitutes acceptance of the updated Terms, unless applicable law requires a different process.

18. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. You and Photo Repair Lab submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and courts hearing appeals from them. If you are a consumer residing outside New South Wales, Australia, nothing in these Terms prevents you from relying on mandatory rights or consumer protections available under the laws of your place of residence. Before starting formal proceedings, each party will use reasonable efforts to resolve any dispute by giving the other written notice of the dispute and allowing at least 30 days for good-faith discussions, unless urgent injunctive or protective relief is needed.
